• “Platform” refers to OrbitJump, the AI-powered virtual lab and associated services.
• “User” means any individual or institution accessing or using the Platform.
• “User Data” refers to any information, files, submissions, content, or activity generated, uploaded, or shared by Users on the Platform.

2. Eligibility

Users must be at least 18 years old, or have consent from a parent/guardian or institution if under 18.

3. Services Provided

• The Platform allows Users to create, upload, and interact with User Data.
• The Platform’s AI may analyze User Data, generate metrics, and provide insights, reports, or analytics.
• Institutions or authorized administrators or any authorized 3rd party may access aggregated User metrics and analytics dashboards.

4. User Obligations

• Users agree to provide accurate information during registration and use.
• Users shall not misuse, disrupt, reverse-engineer, or attempt unauthorized access to the Platform.
• Users are responsible for maintaining the confidentiality of their login credentials.

5. Data Usage and Ownership

• Users retain ownership of their User Data.
• By submitting User Data, Users grant the Company a non-exclusive, royalty-free, worldwide license to use such data for processing, analytics, model training, research, and product improvement.
• The Company may use aggregated and anonymized data for insights, benchmarking, and marketing purposes.

6. Third-Party Services

The Platform may integrate with third-party APIs and services. Users acknowledge that User Data may be shared with such third parties and must independently review their Terms of Service and Privacy Policies. The Company shall not be held liable for third-party services or their data practices.

7. Intellectual Property

• All intellectual property in the Platform, including software, algorithms, and AI models, belongs exclusively to the Company.
• Unauthorized reproduction, distribution, misuse, or modification of the Platform is prohibited.

8. Disclaimer of Warranties

• The Platform and all related services are provided “AS IS” without warranties of any kind.
• The Company does not guarantee absolute accuracy, reliability, or uninterrupted availability of analytics, reports, or services.

9. Limitation of Liability

• To the maximum extent permitted by law, the Company shall not be liable for indirect, incidental, or consequential damages.
• The Company’s total liability shall not exceed the amount paid (if any) by the User or Institution for the use of the Platform.

10. Suspension and Termination

• The Company may suspend or terminate User access in case of Terms violations or misuse.
• Institutions may terminate their subscription with written notice, subject to applicable agreements.

11. Governing Law and Jurisdiction

• These Terms are governed by the laws of India.
• Disputes shall be subject to the exclusive jurisdiction of the courts in Rampurhat, West Bengal.
